Am I the only one that is fed up?

Generally I try not to get involved with the crap that happens on here.. but the whole copywright thing is really annoying!

Don't get me wrong... I am all to aware of the importance of copywright, I studied this for 3 years at Uni in terms of the legalities from a journalists point of view. However, if people actually looked at the convention most countries adopted, and look at case law the individual is the one making the breech...not minti. Minti has an adequate disclaimer and I am sure their lawyers have looked into this in great depth.

However, this is not my main problem, what really worries me is how a person is not allowed to make a mistake on here. I do not know Belinda, but it seems she made a mistake in thinking she had the right to use some information and posted it as (really good) advice. Apparently, mistakes are not allowed?!?!? I find this a very sad state of affairs.. if this is the values we hold, what are we teaching our children? If we come across something like this, why not just contact the person and ask them directly and work with them? Any copywright cases that are taken to court (very few cases) take years to get a hearing and resolved, a few e-mails before reporting is nothing in the scheme of things.

I really hope that we can start acting more like parents and coach and nurture others who make mistakes like we would with our wee ones!

Re: Am I the only one that is fed up?

Well, I for one as sick of the crap that is going on.  Copyright or not.  But anyway, I am not abreast with copyright laws so I can only go by what I know.  It isn't allowed.  I agree that mistakes are made, we are in fact only human.  And, that mistakes should be allowed.  I don't know what the magical answer is for the latest occurences.

The following is from the Digital Millennium Copyright Act as it relates to Minti...

DMCA Title II, the Online Copyright Infringement Liability Limitation Act ("OCILLA") creates a safe harbor for online service providers (OSPs, including ISPs) against copyright liability if they adhere to and qualify for certain prescribed safe harbor guidelines and promptly block access to allegedly infringing material (or remove such material from their systems) if they receive a notification claiming infringement from a copyright holder or the copyright holder's agent. OCILLA also includes a counter-notification provision that offers OSPs a safe harbor from liability to their users, if the material upon notice from such users claiming that the material in question is not, in fact, infringing. OCILLA also provides for subpoenas to OSPs to provide their users' identity.

I have bolded and italicized the portion that does in fact make Minti liable.  I know that it states "if it recieves notification", but as this is a site for parents by parents, it is our responsibility to make sure that the content isn't in fact a copyright violation.

Now, as for the fact that Bel wasn't given the opportunity to make amends, from my understanding, she was notified but just didn't act quick enough.  And rightly so, if there is something on Minti that is illegal, then it should be taken off and deleted or rectified.

Just my thoughts.
Angela
