Childrens parties and how to advoid a law suit

I think it is sad and disgusting how in todays world you cant have a childrens party the way we used to without having a potential law suit... i understand this to be the reason most people go to Mcdonalds or Hungry Jacks (beside the fact that they are usualy cheaper) but when my friend wanted to have one for her son we got together and come up with a few ideas that you could use!

  1. We wrote a mini contract that the parents had to sign and attached it to the Invite.

basically it stated that the parent/gaurdian of  ________ (invited childs full name) Understood and agreed that the parents of __________ (her childs full name) are not responsible and will not be held accountable for the safety of that child. it also said that they understand that they the parent must also attend the party to ensure their childs safety.  (We also put a cover sheet with this saying that although we have taken every measure to ensure you childs safety we cannot guarantee it which is why your child will not be alowed to attend without a parent or guardian and if the following isn't signed and returned)

We then sent the invite directly to the parents of the child just to make sure they got it!

     2.    We cleaned up the yard and made sure there were no holes or anything we deemed unsafe we also cleaned the house just to make sure.

     3. We wrote out a list of all the games and activities we were going to do and handed a copy to all parents so they understood them and the risks involved. Not that there realy was any.

     4.   Food was labeled with a list of ingredients should anyone have a food alergy.

    5.   We also had a guest book that had to be signed by each parent as well and at the top of the page it said that by signing this they understood that they were soley responsible for the safety of their child.

All in all we had a fun time and yes no one got hurt but we wanted to be safe rather than sorry. Law suits are expensive!!!

Sad day when you have to do this.....

I would think if I was inviting children to my place for my son's birthday party that I would be the one responsible for the safety and well being of those who attended and yes as mumtobekim says I believe that it is covered in your house insurance. And if it is not you should look into it..

Would writing a contract up like that actually be a leagal document?

if you get a witness signature and you give out all the correct warnings yes it would be i asked a friend who studied law..

Wow I did not think it would come to this.

I suppose this is the day when you cannot have children over to play if this is what it leads to. 

When I have a party I generally will organise it and have it at McDonalds Or Hungry Jacks.  No mess no worry about the lawsuits.

You will probably find out who your true friends are if this happens.

My boy is about to turn one and law suits are rampant now. Hate to think how they will be when he gets older .. something I will think about for the future ! thanks

It is really sad that it has come to this.
It is really sad that it has come to this. I thought that the public liability cover which is part of house or contents insurance would cover children's birthday parties at home. If you have the birthday party at a park who is responsible?

Well most likely it would be the Local Council or Govenance you would have to take to court.

In Australia there was a rampant lawsuits happening over footpaths a few years back.  Our local council when bulistic fixing any paths that deemed unsafe.

Who is responsible if something happens at the park.
In the past few years Australia has actually overtaken the US with the amount of lawsuits per capita. unbeleivable!
