Gosh yes, you will need to take legal action if these men won't do the responsible testing.  If not for financial reasons, it is very important that you have as many details as possible about her heritage for medical purposes as well.

(Not to mention, she will want to find out about her 'other' family at some stage - it is part of who we are).
