what age can a child choose which parent to live with

ok so some of u know my story but for those of u who don't... My 2 older girls live with their dad.. the 15 y old has now decided she no longer eants to go to school... dad says that's ok but she has to get a job... they live in a small small town no chance of her getting a job there... So if she were to get a job in my town it would make sense for her to live here with me... there town is about 40 km away... Of course if she were to live here i would want her to go to school she seems ok with that  wich mean there is a problem at her old school... school or the ppl there i'm unsure off.. and she can get a part time job if she want to.. I've tlk to her about this and she has decided she want to live with me.. i supose my question is at what age can kids choose who they want to live with?  And can her father stop her fromm coming in here with me?

dose anyone know the answers for sure.. from personel experience.....

Hi, well your daughter is definitely old enough to choose who she lives with & if there are no court order's in place then her father can do nothing to stop her from making that decision.

We are going through a similar situation with my husbands son but the difference is there are court orders & Jordy is on 6 1/2.

 But as far as I know if you involve a social worker who can determined that there has been no influence from the parents about the decision that the child has made the age when the courts will listen is 8 but don't quote me on that.

But yes your daughter is well & truly old enough to make that decision on her own.

Hope everything works out for you because your right in wanting her to finish her schooling & it's great that you support her in wanting to work & suggesting that she do both because that's what a good parent dose (please don't think I was having a go at your ex I just think that he should have suggested what you have first before he agreed for her to leave school)

I would say your daughter is old enough to a make the choice who she lives with.  I believe the age that they start taking a child's opinions in is about 12 years.

As far as I know, the age is 12, but the age of a lot of things with kids changes often. I suggest you ring the magistrate at your local court & ask him/her so you know the exact age as it is right now.

my sis had to deal with all of this with her step kids. K still has to live with her mum as she is under 12 but after 12 they can go to court and chose (if the parents cant decide that is).

ok so 12 seems to b the age everyone is sugesting.. So when ex comes to pick the kids up monday 4 pm there should b nothing he can do when we teel him that she's staying...

I know when i was younger the age was 16 that the child can choose which parent they want to live with but that is going through the court system. Not sure if it has all changed.

My son left at 13 years to live with his dad. My kids have all gone to live with there dad at some time during that time (4 years ago) My youngest is living with his dad now. We had no court orders though. As long as I knew that they were safe, then I wasn't going to fight that anyway as if I forced them to come back they would only make my life hard. When they wanted to come back home, that was a different story. I would have fought then, but I didn't need to. They are not a possesion and I think if she wants to come back and live with you cause work opportunities are better and she is safe and happy to do that then it should be fine. Best if dad agrees to it but she can make that decision at 15.

I really don't think her father is going to like it to much.. He told her on friday that HE would let her come here for one week, if no job then she must return to him... I told her she can stay as long as she wants to but i would like her to give it atleast a few months if she dose not like it in toowoomba then she can go back if she wants....i don't think he's gonna like like the idea of her stayin for that long tho....

Thats crazy. It will take longer then a week to get a job, though Maccas and such are always calling out for these young ones. My kids have never found dramas getting fast food jobs! Check your mail as I have told you my story. LOL

Not 100% sure, but I believe that 12 or 14 is the age where kids can make the choice.
