my kids might be moving interstate

My girls mother advised me she is moving from Vic to Qld, i currently live only an hour away  from my girls this move will limit my contact dramatically. Im not sure if this is true as the mother is always trying to upset me. Can i prevent this from happening if it is true?

Yes if you have contact with them on a regular basis you can actually stop her from leaving with your children . When we moved here 4 years ago my step - daughters mother tried doing it she went to her solicitor we went to court back where we used to lkive the judge's reasoning for us being able to bring my step daughter here is because her mother had very little contact with herand the fact we moved to save her from dangergo to ur solicitor you stand a good chance. The only thing you can do is go through the courts and show just cause to how this will impact on your life as well as the life of your daughter.

I would say that an injunction could be sort to prevent her moving that far, unless the mother is moving to take up a job that she has applied for and already gotten prior to moving.  All other reasons have to be taken on a case by case basis.

The fact the your ex is always trying to upset you makes me think that she is wanting to hurt you.  I don't know the specifics of what is going on, but it seems to me she is one angry mother and trying to get revenge.  Unfortunately, she has not thought of how this affects your daughter, and this actually works in your favour.

Take it through the courts to get it sorted.  Your local centrelink office will be able to help you find the right groups to do this through.

you picked her in one, she has never stopped being hurtful. We have been seperated for years and she keeps this sort of thing up regularily. It has been suggested i attempt mediation before going to the courts??????

thanks......i just dont want the whole drama of the courts again. But if its gotta be done. She has said stuff like this before to try and upset me so i still dont know if its for real, my girls dont know anything about it.

Yes you can!! My brother stopped his ex from moving from NSW to QLD because if the moved took place he would hardly ever see his son. You need to contact your local court house for the best advice or hire an attorney to get her in court to stop the move.

thats how it would be for me. I really dont want to go back to court but she leaves me no choice, im not even sure she is serious...its possible she just wants to stir me up but i think i have to start the process.

hey, yes you can prevent this, you could go to legal aid and apply for joint custody or sole parent custody. legal aid will be able to advice you of what your rights are and what her's are.You could also contact docs as they could beable to help out as well

every little bit of advice helps, thanks. I will have to seek legal advice, i wouldnt try to prevent this happening if i felt it was in the best interets of my girls....but i just cant see how even less contact with them will benefit them.
