Court order re contact.

Good morning minti pals. As some of you know my ex took me to court 5 years ago, when the twins were 5 for contact and parental responsibility.He was denied both and hasn't seen them now for 5 years.

Does anyone know if the court order lasts until they are 16 or only for a period of time.There is nothing in my legal documents that suggests it is short term but it worries me that he could apply again for contact.

I've never been in the position of having to deal with the Familyy Courts for custody or access (might have something to do with the fact my partner and I are super glued at the hip), so I'm not entirely sure about how it works.

I was, however, under the impression that there was supposed to be a regular review of the orders, about every 6 months(?).  Like I said, not entriely sure.

I do also know that your ex can asked for it to be reviewed on a regular basis too, as can you.

A Family Court Order will either specify an end date, or will last until the youngest person on the order turns 18. However, either party (that is you or your ex) could apply to have the orders changes at any stage. Having said that, simply applying for a change to the orders doesn't mean they WILL change- if the same circumstances exist that denied him access in the first place still exist, I would hope the courts wouldn't change the orders.

If it's a Family Court order than as far as I know, yes, it's permanent. You can always ring your local court house to find out, they'll be able to help you and put your mind at ease.

I think if it was a family court he can reapply when ever, but it should last until your kids are 16/18 otherwise. If he reapplies the new judge can over rule the previous decision for what ever reason. Unfortunately situtions change and 2 peoples opinions can vary greatly. Has he given you any reason to believe that he may want to try the courts again? If so set yourself up with a lawyer or some kind of legal aide and find out where you stand as it would be easier incase he does try again. Hope this helps.

hi sweetie.

It really depends upon what type of court order it is. If it is a family law order i am not sure, but if it is an AVO or a DVO they can last anywhere from 12 months and on some very rare and special cases they can be had for 5 yrs.
